Terms of Service

These Terms of Service (“Terms”) govern your use of the Side-Pilot macOS application and the website at side-pilot.com (collectively, the “Service”). Side-Pilot is operated by an individual developer based in China (“we”, “our”, or “us”). By downloading, installing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. License Grant
Subject to your compliance with these Terms and full payment of any applicable fees, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Side-Pilot on the number of devices permitted by the license tier you purchased.
The free version may be used at no cost subject to feature limits set within the application.
2. Restrictions
You may not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of Side-Pilot, except to the extent such restriction is prohibited by applicable law.
- Redistribute, sublicense, rent, lease, or sell the application or any part of it.
- Share, publish, or transfer your license key to any third party.
- Use the Service to violate any applicable law or regulation.
- Circumvent or attempt to circumvent any licensing or activation mechanism.
3. Purchases and Refunds
Payments are processed by our merchant of record (Creem and/or Paddle). When you make a purchase, your payment is subject to the payment processor’s own terms in addition to these Terms.
We offer a refund within 14 days of purchase if you are unsatisfied with the Service, provided no abuse of the licensing system has occurred. To request a refund, email [email protected] with your purchase email and license key.
4. Updates
We may release updates from time to time. Updates may add, modify, or remove features. We do not guarantee continued availability of any specific feature.
5. Ownership
Side-Pilot and all associated intellectual property remain owned by the operator. These Terms do not transfer any ownership rights to you; you receive only the license described in Section 1.
6. User Conduct
You are responsible for your use of the Service and any content you produce using it. You agree not to use the Service in any way that infringes the rights of others, harms third-party systems, or otherwise violates applicable law.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) USD 50.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your license if you materially breach these Terms (for example, sharing your license key, attempting to circumvent activation, or using the Service unlawfully). Upon termination, you must cease all use of the Service.
10. Privacy
Your use of the Service is also governed by our Privacy Policy.
11. Changes to These Terms
We may modify these Terms from time to time. Material changes will be reflected by updating the “Last updated” date at the top of this page. Continued use of the Service after such update constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the competent courts of the People’s Republic of China.
